Davis & Associates Helps Companies Navigate H-1B Visa Process

Dallas immigration law firm handles all aspects of immigration law

DALLAS, TX – FEBRUARY 1, 2017Companies reliant on skilled workers from overseas anxiously await word on possible changes likely under President Donald Trump. Dallas immigration law firm Davis & Associates stands ready to help employers navigate through what often can be a tricky process.

Attorneys at Davis & Associates handle all aspects of immigration law including employment-based immigration. They are preparing for what is usually a busy period as companies prepare to seek what is a limited number of new H-1B visas granted each year.

An H-1B visa enables a business to hire foreign workers for specific positions in the United States. They may be granted for workers needed to fill jobs that require “specialized knowledge.” That means the job requires someone with a bachelor’s degree and/or work experience in the specific field.

The United States limits the number of new H-1B visas to 85,000 per year. An overseas skilled worker seeking an H-1B visa must have a job offer and company sponsorship. The company must prove to the U.S. Citizenship and Immigration Services agency that the job is a “specialty occupation” and the skilled worker will be a bona fide employee of the company sponsoring the visa.

The USCIS reportedly received more than 236,000 applications between April 1 and April 7, 2016, for an Oct. 1, 2016 start date that coincided with the government’s 2017 fiscal year. The entire 85,000 H-1B visas were allocated within a week.

It’s not an easy process and is likely to change. President Trump has already signed a series of executive orders related to immigration and changes to the H-1B visa program are expected soon. Congressional leaders are also preparing to introduce new bills concerning skilled worker visas.

More than ever, companies are cautioned to seek expert help as they navigate through the process. Davis and Associates business immigration law firm provides expert legal counsel in all practice areas of immigration law including employment-sponsored immigration.
