Davis & Associates is preparing clients for recent changes to the application and interview process for pending political asylum cases.
Until recently, the oldest political asylum applications were processed first, causing some cases to remain pending for up to a year before the applicant was ever able to schedule an interview with The United States Citizenship and Immigration Services (USCIS).
This allowed immigration lawyers to work asylum cases in strategic stages and applicants were permitted to find work during the processing time; it also caused the backlog to grow exponentially and permitted potential fraud and abuse of the system.
To combat these issues, on January 31, 2018, USCIS announced a plan to address the growing backlog for political asylum applications.
According to USCIS, moving forward, all affirmative asylum interviews for recent applicants will be scheduled ahead of interviews for applicants of older filings, making sure to follow these three priorities:
First priority: Applicants who had previously scheduled interviews that needed to be rescheduled due to applicant request or USCIS needs
Second priority: Applications that have been pending 21 days or less
Third priority: All other pending applications starting with the newer filings and working backward
